Bitrig Terms of Service

These Terms of Service (“Terms”) form a legally binding contract between you and Bitrig, Inc. (“Bitrig,” “we,” “us,” or “our”). By installing or using the Bitrig mobile app, website, or related services (“Service”) you agree to these Terms and to the Privacy Policy. We operate the Service from the United States and make no claim that it is appropriate or available outside the U.S. If you access Bitrig from another country, you do so voluntarily and are responsible for compliance with local laws.
1. Eligibility
You must be at least 13 years old (or the minimum age in your country) and able to form a binding contract.
2. Accounts and Subscriptions
- Creating an account is required. Keep your credentials secure.
- The Service is offered through a monthly subscription billed through your App Store. Prices may change on renewal with prior notice.
- Subscriptions renew automatically until cancelled in your App Store settings. Access continues until the end of the paid term.
- Payments are non-refundable except where the law requires.
- If you are in the EU/UK you acknowledge that digital delivery begins immediately and you waive the 14-day withdrawal right.
3. License Grant and Restrictions
We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service and any code it generates.
You must not
- use the Service except for lawful purposes,
- reverse-engineer or scrape the Service,
- resell or rent access,
- bypass rate limits,
- upload unlawful or harmful content, or
- use the Service in violation of export-control or sanctions laws.
4. User Content and Generated Code
You own the code, projects, and messages you create. You give Bitrig a limited license to store, process, back-up, and in anonymized form analyze that content to improve the Service and its AI models.
Generated code is supplied as-is; you must review and test it before production use.
5. Shared (Public-Link) Projects
Bitrig projects are private by default. When you tap Share, Bitrig generates a public link:
- Anyone who has that URL can view the project, even without a Bitrig account.
- Logged-in Bitrig users can “remix” the project and create derivative works.
By sharing a project you (a) confirm you have the right to do so, and (b) grant Bitrig, Inc. and all link holders a perpetual, worldwide, royalty-free license to view, copy, modify, distribute, and create derivatives of that project.
If you shared something by mistake, email support@bitrig.app and we will remove the public link as soon as reasonably possible. Copies or forks that were created while the link was active may continue to exist under the license already granted.
6. Feedback
Suggestions or bug reports you send may be used by Bitrig without compensation.
7. Promotions
If we run a contest or promotion, separate rules will apply. Participation constitutes acceptance of those rules.
8. Updates and Service Changes
We may add, change, or remove features or discontinue the Service at any time. We will give advance notice of any major change when practical.
9. Intellectual Property
All Bitrig trademarks, logos, and non-user content are owned by Bitrig, Inc. Except for the limited license above, no rights are granted.
10. DMCA Notice
If you believe content on Bitrig infringes your copyright, send a takedown notice to support@bitrig.app. We may remove material and terminate repeat infringers.
11. Disclaimers
The Service and all generated output are provided “as is” and “as available.” Bitrig makes no warranty of accuracy, security, or fitness for purpose.
12. Limitation of Liability
Bitrig is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill. Our total liability will not exceed the amount you paid Bitrig in the twelve months before the claim.
13. Indemnification
You will indemnify and hold harmless Bitrig from claims and losses arising from your content, your code, or your breach of these Terms.
14. Export Compliance
You may not use the Service if you are subject to U.S. sanctions or located in an embargoed country.
15. Termination
You may stop using the Service at any time. We may suspend or terminate your account for breach or if we discontinue the Service.
Sections 4 through 6 and 9 through 18 survive termination.
16. Force Majeure
Bitrig is not liable for failure to perform due to events beyond reasonable control, including internet outages, natural disasters, or regulatory actions.
17. Governing Law and Dispute Resolution
These Terms are governed by California law (USA) without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in San Francisco County, California. You waive class-action rights.
18. Severability and Waiver
If any term is found unenforceable, the remaining terms remain in force. Failure to enforce a provision is not a waiver.
19. Entire Agreement
These Terms and the Privacy Policy are the entire agreement between you and Bitrig regarding the Service and replace any prior agreements.
